CONTRAT DE TRAVAIL VS BÉNÉVOLAT
Dans une décision du 20 décembre 2017, la Cour de cassation a jugé que la nature de la relation entre un bénévole et l’association dans laquelle il exerçait devait être requalifiée en contrat de travail, en raison du fait que l’association avait défini ses missions et horaires de travail de façon unilatérale, moyennant une rémunération en nature. La Cour de cassation a considéré qu’un lien de subordination existait bel et bien. ■
